Case Challenges Certifications and Accuracy of the LEED Program
On February 7, 2011, an amended
complaint was filed by a group of design professionals in an action
against US Green Building Council (USGBC) in the United States
District Court for the Southern District of New York. USGBC is the
creator, owner, and operator of Leadership in Energy and
Environmental Design (LEED). The basis of Plaintiffs’ amended
complaint is that USGBC has falsely advertised and marketed the LEED
program, thereby harming their own business opportunities and
misleading consumers into believing that LEED certification is the
only way to have an energy efficient building. They allege that
LEED-certified buildings are no more energy efficient than
non-LEED-certified buildings and may actually use more energy. The
Plaintiffs also claim that USGBC conducts no site investigations or
verification and allows applicants to self-certify themselves. They
further claim that LEED ratings are not based on objective
scientific data. Plaintiffs seek injunctive relief and damages for
false advertising under both federal and state law. The defendant’s
response to the amended complaint is due April 6, 2011.

11.05.10:
Michael I. Less Receives the Don L. Smith Award
The TACC is proud to
announce Michael I. Less as the recipient of the Don L. Smith Award,
which was awarded to him at the 2010 Annual Meeting. The Don L.
Smith Award is given in recognition of lifetime achievement in the
advancement of construction law in Tennessee. Not only has Mike Less
served a fundamental role in the TACC, but his contributions to the
construction law bar have been immeasurable. Mike has authored books
and articles that are valuable to Tennessee practitioners, as well
as attorneys across the country. Mike is only the third recipient of
the Award since the TACC began in 2004. He is well deserving and we
extend our warm congratulations and thanks to Mike Less for his
continued support and service to TACC and its members and for his
on-going contributions to the practice of construction law.
